A proposed settlement has been reached in a class action lawsuit filed in California. A Purchaser of a certain Covered Product (as defined in this Notice) has sued Raw Farm, LLC formerly known as Organic Pastures Dairy Company (“Defendant”), alleging that Defendant made false, deceptive, and/or misleading claims on the labeling and packaging of the Cream Top — whole Raw Milk Product with particular labels (the “Covered Product”), as well as on the web pages for the Covered Product. Defendant denies the Plaintiff’s allegations and any wrongdoing. The court has not decided which side is right. Instead, the parties have decided to settle the case.

The proposed settlement (the “Settlement”) provides for an award of the following to any individuals who purchased any of the Covered Product and submit a valid Claim Form: (1) a pro rata payment from the Settlement Class Fund of $40,000. The amount is to be determined based upon how many class members make valid claims.

The Settlement provides that Defendant will pay combined attorneys’ fees and litigation costs for the remaining amount from the common fund of $280,000 less the Settlement Class Fund, the Service Award, and the Class Administration costs, which will be $186,395 if approved by the Court. This amount consists of $6,503.36 in litigation costs that have been incurred thus far by Plaintiff’s counsel. Any additional costs incurred by Plaintiff’s counsel will come out of the $186,395. The Settlement also provides for a service award to the Named Plaintiff of up to $5,000, and reasonable notice and claims administration costs capped at $50,000.

Further, Defendant has agreed to making certain changes to the manner in which it labels and advertises the Covered Product. A description of the Covered Product may be found by reviewing Exhibit D in the Settlement Agreement.

You are a “Settlement Class Member” if you purchased the Covered Product made by Defendant, for personal use, and not resale or distribution, in California between May 1, 2020, through July 1, 2020.

If you are a Settlement Class Member, you can submit a claim for a settlement award.
